At the very outset, learned counsel for the petitioners prays for and is permitted to correct the prayer clause. He may do so during the course of the day.
Heard learned counsel for the petitioner and learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayer:-
"issue a writ, order or direction in the nature of Mandamus directing the respondent no. 2 to decide the application dated 26.09.2019 within stipulated time pending in Suit No. 65/ 2004-05 under Section 229-B of U.P.Z.A. & L.R. Act as this Hon'ble Court may deem fit and proper."
Attention of this Court was drawn to the order dated 2.8.2019 passed by the revisional court.
In view of the aforesaid order and the observations made therein respondent no. 2, The Assistant Collector 1st Class/ Sub- Divisional Officer, Ghatampur Kanpur Nagar is directed to consider and decide the application 26.09.2019 in accordance with law, preferably within a period of two months from the date of production of self- attested copy of this order, which may be verified from the official website of this Court, provided the functioning of the authority concerned is not affected due to any reason related to COVID- 19 Pandemic.
With the aforesaid observation/ direction, present petition stands disposed of.
