1. Heard learned counsel for petitioner and perused the record.
2. Additional District Magistrate/ Officer Incharge, Enemy Property, Saharanpur has passed order dated 18.07.2018 declaring disputed property as Enemy Property under the provisions of Enemy Properties Act, 1968 (hereinafter referred to as “Act, 1968”).
3. Learned counsel for petitioner, at the outset, admitted that against impugned order petitioner has remedy under Section 18 before Central Government and further submitted that he has already approached Central Government by making representation dated 24.12.2018 and his grievance is that the same has not been decided so far.
4. Representation has been made only just about one and half months back and, therefore, it cannot be said that there is any undue delay in disposal of matter by Central Government.
5. Be that as it may, since petitioner has already approached before Competent Authority, we hope and trust that Competent Authority under Section 18 shall take a final decision in the matter expeditiously and in any case within three months after giving due opportunity to all concerned parties in accordance with law.
6. With aforesaid direction writ petition id disposed of.
