Learned counsel for the petitioner at the very outset submits that he wants to pay outstanding dues of the bank in respect of which recovery citation has been issued by Tehsil authorities on 2nd June,2018 for a sum of Rs.11,41,732 along with interest.
Sri Y.K. Narayn, learned Advocate, holding brief of Sri Krishna Mohan Asthana, learned counsel appearing for the bank does not have any objection in case if some installment is facilitated in favour of the petitioner for the payment of dues.
In view of the consent being accorded by the bank the writ petition is disposed of with a direction that no coercive measures shall be taken against the petitioner pursuant to recovery citation dated 2nd June, 2018 provided:-
(A). The petitioner shall pay Rs.1,00,000/- by 30th June, 2019 and Rs. 1,00,000/- by 31.July, 2019. On payment of the first installment the bank shall supply all outstanding dues along with interest payable on the amount of the dues within two weeks thereafter.
(B). The rest amount shall be paid including the amount of the interest to be paid by the petitioner in the next 4 bimonthly installments.
However, no recovery charges shall be relaized from the petitioner in respect of the recovery citation issued.
It is, however, made clear that in the event of default of any of the directions contained hereinabove, the protection granted under this order shall seize to exist and bank shall at liberty to proceed in accordance with law to recover the amount.
