Heard learned counsel for the parties.
This writ petition has been filed by the petitioner with the following prayer:-
(i) issue a writ, order or direction in the nature of mandamus commanding the respondent no. 3 to forthwith lease back in favour of petitioners their abadi land being Khasra No. 139M area 0-11-5 Bigha situated in Revenue Village- Chhajarsi, Pargana and Tehsil- Dadri, District- Gautam Budh Nagar.
(ii) issue a writ, order or direction in the nature of mandamus commanding the respondent authority to decide the representation of the petitioner dated 14.01.2019 (Annexure No. 6 to the writ petition).
(iii) issue any other suitable writ, order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in favour of the petitioner.
(iv) award cost of this petition to the petitioner.
Having perused the averments made in the writ petition and the documents appended thereto, we find that for redressal of his grievance, the petitioner has already filed his representation on 14.1.2019, copy whereof has been filed as Annexure No. 6 to the writ petition, before respondent no. 3, but the said representation has not been decided till date.
In view of above, without expressing any opinion on the merits of the case, we dispose of the writ petition with the direction to respondent no. 3 to decide the said representation filed by the petitioner before him on 14.1.2019 (Annexure No. 6), within a period of one month from the date of filing of the certified copy of this order before him, strictly in accordance with law, by a speaking and reasoned order.
