JUDGMENT / ORDER

1. By way of the present petition preferred under Article 227 of the Constitution of India through learned advocate Mr.A.R.Majmudar on 4.2.2012, the petitioners have challenged the order of the trial Court dated 12.1.2012 rejecting the application preferred vide Exh.144 for bringing the heirs of the deceased defendant on record.
2. This matter has come up on the Board six times. However, on account of illness of learned advocate Mr. Majmudar, the same is not being proceeded with. Learned advocate Mr. Prabhav Mehta appearing for the parties, who have not been impleaded as parties in the present petition urges that the proceedings of RTS Appeal No.229 of 2011 are not being proceeded with only on the count that this petition is pending. He also contemplates to bring on record the detailed facts by preferring an appropriate application.
3. Considering the sick note of learned advocate Mr. Majmudar, matter is being adjourned to 12.3.2012. However, it is being specified that the pendency of this petition may not come in the way of the authorities to decide the issue in accordance with law.
