Ramanlal vs Appearance

High Court Of Gujarat|03 July, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The basis of the present petition is the order dated 17.10.2011 passed by this Court in Special Civil Application No.15183 of 2011 and others, whereby the direction was given by the learned Single Judge of this Court to the respondent Authorities to examine the case of each of the petitioners, in light of the scheme approved by the Apex Court in the case of Gujarat Agricultural University. However, the language used is that the decision be taken as early as possible. Since no outer limit has been provided to take decision, we find that it is not a case to initiate the action under the Contempt of Courts Act at this stage, but at the same time, if the outer limit is provided for compliance of the direction, the same would meet with the ends of justice.
Hence, the present petition is disposed of with the observations that the respondents shall comply with the direction of this Court in Special Civil Application No.15183 of 2011 and allied matters dated 17.10.2011 within a period of six weeks from the date of receipt of the order. The petitioner shall additionally produce a copy of the order passed in SCA No.15183 of 2011 together with the copy of the present order. In the event the direction is not complied with, the petitioner may approach this Court in accordance with law.
The application is disposed of accordingly. Direct service is permitted.
