Heard learned counsel for the petitioner, learned counsel for the Gaon Sabha and the learned Standing Counsel for the State.
After due deliberation at length, learned counsel for the petitioner has confined his argument only with respect to prayer no. (a), which is being quoted herein below:-
“a. writ order or direction in the nature of mandamus commanding the respondent No. 3 to decide the petitioner representation dated 8.7.21 (Annexure No. 9)."
It is submitted by the counsel for the petitioner that petitioner has moved a representation before the authority concerned for permission to carry out the fishing from the pond in question on the basis of the previous lease deed because during the prescribed period he could not carry out the fishing process due to Covid-19 pandemic. The representation moved by the petitioner is still pending consideration before the authority concerned.
Learned Standing Counsel as well as counsel for the Gaon Sabha have no objection if a direction is issued to the authority concerned to decide the aforesaid case at the earliest.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to the Sub Divisional Officer (respondent no. 3), before whom the aforesaid representation is pending, to decide the same strictly in accordance with law, expeditiously, preferably, within a period of one month from the date of receipt of a certified copy of this order.
With the aforesaid directions, present writ petition is disposed of.
