RE: Civil Misc. Substitution Application No.2 of 2018 The substitution application is allowed.
Let the same be incorporated forthwith before issuance of a certified copy of this order.
In pursuance of the order dated 14.02.2019, the affidavit of compliance has been filed in paragraph 4 whereof, the following averment has been made -
".4. That it is further respectfully submitted that the deponent submitted his unconditional and unqualified apology before this Court by his folded hands and ensuring to this Court that in future no such mistake will be repeated by the deponent. The deponent is praying for the mercy of this Hon'ble Court, whose future career is depend under the merciful hands of this Hon'ble Court."
In view of the aforesaid, the notice issued to Shri Ajay Kumar Awasthi is withdrawn subject to payment of costs of Rs.10,000/-. The cost may be deposited within 3 days from today in the registry of the High Court.
Moreover, for the reasons, which have been given in the order dated 14.02.2019, the impugned order dated 25.10.2018, is hereby quashed.
The Revision No.RST/120/2014 computerized Case No.D2014142900120, under Section 48 of the U.P. Consolidation of Holdings Act, which is pending consideration shall be decided on its merits and without being influenced by order dated 25.01.2019, which has been quashed herein-above.
Subject to the above, this writ petition is allowed.
