Heard Sri R.S. Dubey, learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
This writ petition has been filed with the following prayer:-
"Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents no.2 and 3 to consider and decide the claim/application u/s 101/77 of U.P. Revenue Code 2006 dated 22.02.2021 pending before respondent no.3 within stipulated time in accordance with law."
It is contended by learned counsel for the petitioners that proceedings of exchange of plot in question is pending before respondent no.3. The sole prayer is made for early decision of the said proceedings.
Learned Standing Counsel does not oppose the sole prayer so made for early decision of the application.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit, with a direction upon respondent no.3-Sub-Divisional Magistrate, Sahjanwa, District-Gorakhpur to decide the application of petitioner, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
