Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"a) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide Suit No.240 of 2017 (Ram Svarup Vs. Ramrup and another), under Section 116 of Uttar Pradesh Revenue Code, 2006 pending in the Court of Upziladhikari, Tehsil Harraiya, District Basti within specific period, which may be fixed by this Hon'ble Court, in accordance with law."
The petitioner is aggrieved because his partition suit filed in the year 2017 has not been decided finally till date.
It is admitted that till date no written statement has been filed. It therefore, follows that the issues have not been framed neither the parties have led their evidence.
Under the circumstances, this writ petition is disposed of directing the respondent no.2, Upziladhikari, Tehsil Harraiya, District Basti to endeavour to decide the mutation case of the petitioner, expeditiously, preferably within a period of eighteen months from the date a certified copy of this order is filed before him.
