Heard learned counsel for the petitioner, learned Standing Counsel and Sri Rohit Yadav, learned counsel for the respondent-bank.
The petitioner submits that he had applied for settlement of outstanding loan under One Time Settlement Scheme (OTS) 2018, which is operative in the respondent bank.
The submission is that the application moved by the petitioner has not been processed by the respondent-bank and the bank has proceeded to make recovery of the outstanding loan.
Learned counsel for the respondent-bank though submitted that a proceeding was undertaken for recovery of outstanding loan from the petitioner but on account of promulgation of OTS scheme 2018, in the month of April, 2018, the said proceeding has not been taken further. The result is that the recovery proceedings are kept in abeyance at the instance of the respondent-bank.
Insofar as OTS Scheme 2018 is concerned, it is admitted to the learned counsel for the respondent-bank that the same is in operation as on date.
In view thereof, without expressing any opinion on the merits of the claim of the petitioner, the present petition is being disposed of with the following directions :-
(1) The petitioner shall move a fresh application along with certified copy of this order seeking benefit of O.T.S. Scheme, 2018 within a period of two months from today.
(2) In case, such an application is filed, the respondent bank would be under obligation to process the claim of the petitioner in accordance with the terms of the Scheme 2018 after verifying about the eligibility of the petitioner for the benefits thereof.
(2) In case, the amount sought to be recovered from the petitioner is settled under the said scheme, the petitioner would be under obligation to repay the said amount within the period provided therein.
Subject to above observations/directions, this writ petition is disposed of.
