The present writ petition has been filed challenging the orders dated 10.8.2020 and 29.1.2021 passed by the Settlement Officer of Consolidation and the Deputy Director of Consolidation whereby the Settlement Officer of Consolidation has modified the allotment of chaks made till the stage of Consolidation Officer and the Deputy Director of Consolidation has upheld the order passed by the Settlement Officer of Consolidation.
It is apparent from the impugned orders that the petitioner as well as opposite party no. 3 and the predecessor of opposite party nos. 4 to 11 were brothers and co-tenure holders.
The dispute relates to Plot No. 251/1 which is adjacent to road. Till the stage of Consolidation Officer, the respondent no. 3 was not allotted any chak on Plot No. 251/1 but was allotted a chak on Plot No. 251/3. Through his impugned order, the Settlement Officer of Consolidation has modified the allotment of chak by allotting a chak to respondent no. 3 on Plot No. 251/1 which is adjacent to road and has, consequently, adjusted the petitioner in Plot No. 251/3 which is adjacent to Canal.
There is no illegality or jurisdictional error in the orders passed by the Settlement Officer of Consolidation and the Deputy Director of Consolidation which have been passed in proceedings relating to allotment of chaks.
The writ petition lacks merit and is, hereby, dismissed.
