This application under Section 482 Cr.P.C. has been filed for a direction to the Addl. District Magistrate, Sadar, Gorakhpur to decide the application of the applicant moved under Section 340 Cr.P.C. in Case No. 55 of 2019, State versus Ashok Kumar Shukla, under Section 133 Cr.P.C.. P.S. Gulriha, District Gorakhpur.
Heard Sri Manoj Kumar Chandel, Advocate holding brief of learned counsel for the applicant, learned AGA and perused the record.
It has been made to appear that there is some application dated 15.4.2017 pending in the court below but no orders have been passed upon the same so far.
In the absence of complete record this Court is not in a position to know the exact status of the case and the reason why the application has not yet been disposed of. However, this application stands disposed of with the direction that if there is some application pending in the court below and no orders have been passed upon the same, the court below shall look into the same and will pass appropriate orders in accordance with law expeditiously as it may deem fit.
With the aforesaid observation, the application is disposed off.
