The sole prayer made in the instant petition is for issuing a direction to the trial Court to decide Misc. Case No. 44/2016, expeditiously.
The said case has been registered on the basis of application filed by the petitioner under Order 9, Rule 4 CPC. It is not clear from the order sheet as to whether opposite parties have been served or not.
In such view of the matter, this Court is not inclined to issue any direction, as prayed for in the instant petition, but leaves it open to the petitioner to make a request for expeditious disposal of the restoration application, soon after the opposite parties to the said proceedings are served.
The petition stands disposed of accordingly.
