Heard learned counsel for the petitioners and Sri Ashutosh Kumar Rai, learned Standing Counsel for the respondents No.1.
In view of the order proposed to be passed, notices need not to be issued to the private respondents.
The petitioners are before this Court for a direction to respondent no.1/Deputy Director of Consolidation, Azamgarh, to decide the restoration application no.1185/2003 dated 3.11.2003 expeditiously within a stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to the respondent no.1/Deputy Director of Consolidation, Azamgarh to consider and decide the aforesaid restoration application in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
