Heard the learned counsel for the petitioner, Sri Nagendra Nath Mishra, learned counsel for respondents no. 3 & 4 and Sri A.P. Paul, learned brief holder for the State-respondents.
Learned counsel for the petitioner states that the petitioner is ready and willing to correct the location of the boundary wall as per the impugned notice. However, he prays for some time being granted for the said purpose.
We are not inclined to grant any time in this writ petition, however, we provide that in case the petitioner approaches the Executive Officer, Nagar Panchayat Ramkola, District Kushi Nagar (respondent no. 4) for granting some time to shift the boundary wall along with certified copy of this order, Executive Officer after considering the facts and circumstances may pass appropriate order considering hardship of the petitioner within a period of one week from the date of its filing, whereafter, petitioner shall abide by the undertaking so given and the order so passed by the Executive Officer.
With the aforesaid observation, writ petition is disposed of.
