By order dated 7.3.2018, the appellate court has allowed adjournment to the appellant on that day but with clarification that since there is no stay of the proceedings of the appeal and therefore the matter would be heard on the next date i.e., 14.3.2018.
The petitioner filed an application before the appellate court stating that he has filed a petition before this Court challenging its order rejecting amendment application and consequently the proceedings of the appeal be stayed. The appellate court has observed that since there is no stay of the proceedings of the appeal by this Court, consequently the proceedings could not be stayed. However, the matter was adjourned on that date as the court had remained vacant earlier since a long time.
This Court does not find any illegality in the impugned order to warrant interference in exercise of power under Article 227 of the Constitution.
The petition lacks merit and is dismissed.
