Learned counsel for the appellant has very fairly stated that the appeal would not be maintainable under Chapter VIII Rule 5 of the Allahabad High Court, Rules 1952 as the writ petition out of which this Special Appeal arises had been filed to challenge an appellate order and the appeal was a Statutory Appeal.
The Special Appeal, is accordingly, dismissed.
