Heard learned counsel for the petitioner and learned AGA for the State.
This petition for writ is before us with a prayer to quash the first information report dated 29.07.2017 bearing Case Crime No. 690 of 2017 pending investigation at Police Station Dhoomanganj District Allahabad pertaining to the offences under Section 385 I.P.C.
Learned counsel for the petitioner submits that no case is made out against the petitioner with regard to allegations contained in the first information report.
On perusal of the first information report, we do not find any reason to interfere with the same as that prima facie discloses commission of a cognizable offence. So far as the issue relating to arrest of the petitioner is concerned, it is suffice to mention that the offence under Section 385 IPC is bailable and is triable by any Magistrate.
In view of it, no need is required to pass any order for staying the arrest of the petitioner.
The writ petition stands disposed of accordingly.
