Heard learned counsel for the applicant and learned A.G.A. for the State.
Submission is that there is recovery of Rs. 1,58,100/- against the applicant. In case, the applicant pays the entire amount under recovery in six equal bi monthly instalments payable from January, 2019 (the first instalment payable on or before 10th January, 2019), the execution of order dated 26.11.2018 passed by Principal Judge, Family Court, Deoria, in Execution Case No. 149 of 2014, shall remain stayed.
However, it is made clear that in default of payment of any instalment, this order shall stand automatically vacated. The court below has liberty to proceeding against the applicant.
With the aforesaid observations, the present application is disposed of.
