On 22.5.2007, this Court passed the interim order staying effect and operation of the order dated 2.9.2006 passed by Sessions Judge, Shahjahanpur in Criminal Special Case No. 48 of 1991 (State Vs. Lekhpal) under Section 19 of N.D.P.S. Act, P.S. Jalalabad, District Shahjahanpur till further orders.
Lastly, this case was listed on 18.5.2007.
On 28.3.2018, the Apex Court in the case of Asian Resurfacing of Road Agency Pvt. Ltd and others vs. Central Bureau of Investigation; AIR 2018 SC 2039 has directed that in all pending cases where stay against proceedings of a civil or criminal trial is operating, the same will come to an end on expiry of six months from today unless in an exceptional case by a speaking order such stay is extended. In the present case, the interim order was not extended and it stands vacated.
In view of above, the present application u/s 482 Cr.P.C. is dismissed for the want of prosecution.
