Heard Ishwar Kumar Upadhyay, learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.1-Settlement Officer of Consolidation, Kushinagar to decide the Appeal No.454/490 filed under Section 11 (1) of U.P.C.H. Act within stipulated time.
The contention of learned counsel for the petitioner is that the appeal was filed on 8.8.1994 against the order dated 29.8.1977, which remain pending till date even after a lapse of 24 years.
Under these circumstances,respondent no.1-Settlement Officer of Consolidation, Kushinagar is directed to decide the Appeal No.454/490 filed under Section 11 (1) of U.P.C.H. Act as expeditiously as possible preferably within a period of four months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
