Heard learned counsel for the petitioner; Shri Vivek Kumar Rai, learned counsel for the respondents no. 1 and 2 as well as learned Standing Counsel for the respondent no. 3.
The petitioners claim that they are bhumidhar of Plots No. 640 and 479. The petitioners have also filed a Khatauni indicating their possession over Plots No. 640 and 479. The grievance of the petitioners is that the respondent no. 2 without any acquisition or being in possession has encroached upon the land of the petitioners for construction of Railway Bridge.
It is to be noted that no authority can interfere with the possession and peaceful enjoyment of the property of an individual except in accordance with law.
The writ petition is disposed of with the observation that the respondents will not interfere in the possession and enjoyment of the petitioners over Plots No. 640 and 479 except in accordance with law.
