Ram Khiladi vs Deputy Director Of Consolidation And Others

High Court Of Judicature at Allahabad|26 September, 2019
|

JUDGMENT / ORDER

Court No. - 19
Case :- WRIT - B No. - 2242 of 2019 Petitioner :- Ram Khiladi Respondent :- Deputy Director Of Consolidation And 13 Others Counsel for Petitioner :- Darwari Lal Counsel for Respondent :- C.S.C.,Arun Kumar Srivastava
Hon'ble Salil Kumar Rai,J.
Heard the counsel for the petitioner.
The present writ petition has been filed against the order dated 30.3.2015 passed by the Settlement Officer of Consolidation, Sambhal dismissing the appeal filed by one Khan Sahb and the order dated 14.5.2019 passed by the Deputy Director of Consolidation in Revision No.363 whereby the Deputy Director of Consolidation has dismissed the revision filed by the petitioner against the order dated 30.3.2015.
The petitioner has no locus standi to challenge the order dated 30.3.2015 passed by the S.O.C in as much as the appeal was not filed by the petitioner but filed by one Khan Sahb and from the records it appears that the appeal was filed against the petitioner. The revisional Court has dismissed the revision on the ground that the revision at the instance of the petitioner was not maintainable. There is no illegality in the reasons given by the revisional Court. Even on merits regarding allotment of Chaks, from the arguments of the counsel for the petitioner, it is evident that the petitioner has already been allotted a Chak on his original holding i.e. plot no.100.
In view of the aforesaid, the writ petition lacks merit and is dismissed.
