Heard learned counsel for the applicant and learned Additional Chief Standing Counsel for the State.
By means of this contempt application under Section 12 of the Contempt of Courts' Act, violation of the order dated 28.11.2018 passed in Writ - C No. 38580 of 2018 is complained of.
A compliance affidavit has been filed by Sub Divisional Magistrate, Machhli Shahar, Jaunpur annexing therewith a copy of the order passed by him on 1.3.2020 disposing of the claim of the applicant on merits clearly noting the order of the writ court.
At this stage, learned counsel for the applicant submits that the order of the writ court has not been complied with.
Having heard learned counsel for the parties, I find that this Court while directing the applicant to approach the authority concerned for redressal of his grievances had made it clear that it was not examining the claim/grievance of the applicant on merits.
In such above view of the matter, it is clear that once the merit has been examined by the Sub Divisional Magistrate, it can be safely concluded that the order of the writ court has been complied with.
In view of the above, no cause of action survives to maintain the present contempt application.
Accordingly, the matter is consigned to records. Notice issued, if any, stands discharged.
However, it is open for the applicant to approach appropriate forum for redressal of his grievances, if so advised.
