The present writ petition has been filed against the order dated 17.4.2012 passed by the Deputy Director of Consolidation, Ghazipur (hereinafter referred to as, 'D.D.C.') modifying the allotment of chaks made till the stage of the Settlement Officer of Consolidation, Ghazipur (hereinafter referred to as, 'S.O.C.') thereby affecting the chak allotted to the petitioner on Plot No. 1641.
A reading of the order dated 17.4.2012 passed by the D.D.C. shows that no reasons have been given in the said order for modifying the allotments. There is no discussion about the case of the parties in the order dated 17.4.2012. The D.D.C. in his order has only narrated the argument submitted by the parties, but the order does not consider either the argument on merits or the order passed by the S.O.C. on merits.
In view of the aforesaid, the order dated 17.4.2012 passed by the D.D.C. in Revision Nos. 1266, 1263 and 1276 is hereby quashed.
The matter is remanded back to the Deputy Director of Consolidation, Ghazipur to pass fresh orders in accordance with law within a period of three months from the date a copy of this order is produced before him and after giving reasonable opportunity of hearing to the interested parties.
With the aforesaid direction, the writ petition is allowed.
