Heard Sri Devesh Kumar Shukla, learned counsel for the petitioners and learned Standing Counsel for the State respondents.
By means of this writ petition, the petitioners have come to this Court, seeking a writ of mandamus directing the respondents to provide adequate compensation in accordance with law as contemplated under the provisions of Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989.
The first information report is stated to have been lodged on 23.09.2013 being Case Crime No. 522/2013 under Sections 147, 354A, 323, 504, 506 IPC, section 11 of the Protection of Children From Sexual Offence Act, 2012 and Section 3(1)(11) of the Schedule Castes and Schedules Tribes (Prevention of Atrocities) Act, 1989, Police Station Sasni Gate, District Aligarh. The compensation has to be applied under the said Act, as such the present writ petition is not maintainable. If the petitioners so advised, they may file a criminal misc. writ petition.
Accordingly, the present writ petition is dismissed as not maintainable.
