Heard Sri S.K. Yadav, learned counsel for the petitioners, learned Standing Counsel for the respondent nos. 1 to 4 and Sri I.S. Tomar, learned counsel for the respondent no. 5.
This writ petition has been filed seeking a direction upon the respondent no. 2 to decide the complaint which has been filed against the respondent nos. 6 to 9 who are raising obstruction in the construction being made by the petitioner over certain part of the land.
The Court had asked the learned counsel for the petitioner to address on the issue as to how writ of mandamus can be issued against the private respondents, on which learned counsel failed to reply and only submitted that the direction may be given to the district authorities to intervene in the matter and decide his complaint.
No such writ can be issued against the private persons and in case petitioner has any dispute with the private respondents, same can be adjudicated by the competent court.
Writ petition fails and is hereby dismissed.
