Heard Sri Pavan Kumar Srivastava, learned counsel for the petitioner and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.1-Deputy Director of Consolidation, Fatehpur to decide the restoration application dated 26.12.2017 filed in reference no. 54/2015 within stipulated time.
The contention of learned counsel for the petitioner is that reference under Section 48 (3) of the U.P.C.H. Act has been decided without hearing the petitioner vide order dated 20.5.2015. Against that order, restoration application was filed on 26.12.2017, which remain pending till date.
Under these circumstances, respondent no.1-Deputy Director of Consolidation, Fatehpur is directed to decide the restoration application dated 26.12.2017 filed in reference no. 54/2015 as expeditiously as possible preferably within a period of six months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
