Heard learned counsel for the appellant and Sri Bhanu Prakash Singh, learned brief holder for the State and perused the impugned judgement and order.
This appeal has been preferred by the sole appellant- Ram Charan @ Gange- against the judgement and order of V Additional Sessions Judge, Moradabad dated 20.02.1984 in Sessions Trial No.543 of 1982, State Vs. Ram Charan & Gange & another and the sentence awarded to him is life imprisonment for offence under Section 302 IPC.
From the perusal of the report of the C.J.M.- Moradabad dated 19.04.2018 which is on record of this appeal as Flag 'A', it transpires that the sole appellant in this appeal- Ram Charan @ Gange has died 30 years before.
Learned State Counsel for the State has submitted that in view of report of CJM- Moradabad dated 19.04.2018, this appeal is liable to be abated.
In view of the submission made by learned State Counsel for the State and on perusal of the recitals contained in report of CJM- Moradabad, this appeal is dismissed as abated.
