The petitioner is aggrieved by the non-payment of salary with accrued interest thereon from 1.8.2003 to 7.8.2003.
Submission of the petitioner is that the salary for the said period has been withheld on account of the criminal case lodged against the petitioner. However, the petitioner has been absolved of all the charges in the criminal case by the Competent Authority and, thereafter, has been allowed to continue on the post of Collection Amin in Sales Tax Department and has retired as such.
Only prayer made during the course of argument is to issue a direction to the respondent No.3 to consider the claim of the petitioner for payment of salary for the aforesaid period within a stipulated time.
To this submission, learned Standing Counsel raises no objection.
In view thereof, without expressing any opinion on the merits of the claim made by the petitioner, the present petition is being disposed of with the direction to the respondent No.3 to consider the claim of the petitioner for payment of salary for the aforesaid period expeditiously, preferably, within a period of one month from the date of submission of certified copy of this order.
