Heard learned counsel for the parties and perused the record.
By means of the instant petition, petitioner is assailing the order dated 31.12.2015 passed by District Magistrate, Ballia whereby plot no. 417 ad- measuing 0.016 hectare vesting in the Gaon Sabha has been granted for construction of building of Vidhik Map Vighyan Vibhag, Rasara, Ballia.
Learned Standing Counsel, at the outset, points out that on the said land the construction of the building has been undertaken. Petitioner has approached this Court after a lapse of six years. Further, a writ petition, being Writ Petition No. 33271 of 2018 (Ram Bharat Vs. State of U.P.) is already pending before this Court. This fact is not disputed by learned counsel for the petitioner.
The remedy available to the petitioner is to file an appropriate amendment application in the pending writ petition. This fact is not disputed by learned counsel for the petitioner.
In view thereof, the petition is disposed of as withdrawn with liberty to the petitioner to take remedy in the pending writ petition.
