Challenge in this writ petition is to the orders passed on an application under Section 28 of the U.P. Land Revenue Act for correction of map and the order dismissing the consequential appeal under Section 210 of the U.P. Land Revenue Act.
The writ petition has been filed stating that the proceedings under Section 210 of the U.P. Land Revenue Act were titled as a revision and since a second revision petition is not maintainable, the instant writ petition has been filed.
The provisions of Section 210 of the U.P. Land Revenue Act provides for an appeal. Merely because it was wrongly titled as a revision, the same will not make it a revision.
Under the circumstances, the petitioner has a statutory alternative remedy under Section 219 of the U.P. Land Revenue Act which has not been availed by him.
The writ petition is therefore, dismissed on the ground of availability of an alternative statutory remedy.
