Heard learned counsel for the petitioner and Shri Abhishek Shukla, learned Standing Counsel. Shri T.M. Khan has accepted notice on behalf of Gaon Sabha.
The petitioner is before this Court for a direction to third respondent to take final decision in respect of proceeding under Section 101 and 102 of U.P. Revenue Code Rules, 2016 being Suit No.T-201805200103834 within stipulated period and for a direction to respondents not to interfere in the possession of the petitioner over the land in question.
Learned counsel for the petitioner makes a statement at Bar that the land, which has been offerred under the exchange has much valuation and Khasra No.312 over which the petitioner has possession, the same may not be allotted/ no third party interest may be created till the disposal of the aforesaid proceeding.
Considering the facts and circumstances of the case, it is expected that the aforesaid proceeding under Section 101/102 of U.P. Revenue Code Rules, 2016 be decided expeditiously and preferably within three months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned. Till the disposal of the same, no third party interest shall be created by either of the parties on the holding, which is under possession of the petitioner.
The writ petition is disposed of accordingly.
