Heard Shri D.M. Tripathi, learned counsel for the petitioners; Shri G.P. Srivastava, learned counsel for the respondent no. 3 and learned Standing Counsel for the State-respondents no. 1 & 2.
The petitioners have taken a loan from respondent no. 3 in 2012 for a sum of Rs. 7 lacs. The petitioners claim that they have deposited Rs. 1,10,000/- towards the payment of loan, but thereafter they defaulted in payment of loan and the account was declared Non Performing Asset (N.P.A.) and now a legal notice has been given to the petitioners for deposit of the remainder amount, which is mentioned as Rs. 8,73,554.04 + interest. Learned counsel for the petitioners admits the liability but submits that some installments may be fixed.
The writ petition is against the demand notice and if the petitioners are ready to pay, they may approach the Bank for fixing of installments. In case such an application is made, the Bank may consider the application of the petitioners and pass appropriate order, as far as possible, within one month from the date a certified copy of this order along with application is presented before the authority concerned.
With the aforesaid observation/direction, the writ petition is disposed of.
