1. Called in revise. None appeared on behalf of the petitioner to press this writ petition. Learned Standing Counsel is present for respondents.
2. By means of the present writ petition, petitioner has sought following reliefs:
"(i) to issue a writ, order or direction in the nature of mandamus commanding the respondents to allow the petitioners to join his duties in view of an order passed by the President, Nagar Panchayat, Chandauli, dated 28.11.2000 (Annexure III to this writ petition).
(ii) to issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to pass an appropriate order on the application of the petitioner dated 16.7.2002 (Annexure-V to this writ petition) with regard to resume his duties in view of the order passed by the President, Nagar Panchayat, and to pay the salary accordingly within a fix period.
(iii) to issue any other and further writ order or direction in favour of the petitioner for whom this Hon'ble Court may deem just and proper in the facts and circumstances of the case and for which the petitioner may be entitled under law, otherwise the applicant/ petitioner will suffer an irreparable loss and injury."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
