Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) issue a writ, order or direction in the nature of mandamus directing theCourt below to consider the stay vacation application dated 04.08.2018 for vacating the exparte stay order dated 13.11.2017 and direct the respondent no.2 Sub Divisional Magistrate, Salempur, Deoria to decide the appeal No.T-201805200200469 U/s 35(2) U.P. Revenue Code, 2006, Sudama and another vs. Ram Avtar within stipulated time fixed by this Hon'ble Court."
Petitioner is aggrieved by the pendency of an appeal filed by the respondents against the mutation order passed in favour of the petitioner. The appeal, which is stated to have been pending consideration since the year 2017.
Under the circumstances, this writ petition is disposed of directing the respondent no.2 Sub Divisional Magistrate, Salempur, Deoria to endeavour to decide the mutation case of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
