Heard Sri Vinod Kumar Tripathi, learned counsel for the petitioner and learned Standing Counsel for respondents no.1 and 13.
Notice need not be sent to respondents no.2 to 12, at this stage.
The present writ petition has been filed with the following prayer:-
"1. Issue a writ, order or direction in the nature of Mandamus directing the Sub Divisional Magistrate, Atarra, District-Banda to decide the Case No.63 of 2007 (Ram Autar Vs. Hari Prasad & others) within a stipulated time as fixed by this Hon'ble Court."
It is contended by learned counsel for the petitioner that the proceedings under Section 229-B of the U.P.Z.A. & L.R. Act are pending consideration since 2007. The sole prayer has been made to conclude the pending proceedings at the earliest.
Learned Standing Counsel does not oppose the aforesaid prayer.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no.1-Sub Divisional Magistrate, Atarra, District-Banda to conclude the pending proceedings, if there is no legal impediment and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of one year from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
