Heard Sri Vishwa Nath Mishra, learned counsel for the petitioner and learned Standing Counsel for respondents No.1 and 2. Notice need not be issued to respondents No.3 and 4 at this stage.
This writ petition has been filed with the following prayer:
"issue a writ order or direction in the nature of mandamus directing the respondent no.2, to decide the Case No.202014360202456 of 2019, under Section 116 of U.P. Revenue Code, 2006, Smt. Mamta Devi Versus Smt. Anara Devi and others pending before the respondent no.2 within specific period as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case."
It is contended by counsel for the petitioner that proceedings under Section 116 of the U.P. Revenue Code, 2006 is pending for partition since 2019. The sole prayer is for early disposal of the aforesaid proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no. 2 to conclude the proceedings of aforesaid case, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of six months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
