Heard learned counsel for the appellant, learned AGA for the State and perused the record.
The instant appeal has been preferred against the judgment and order dated 10.9.1991 passed by the VIIIth Additional District and Sessions Judge, Aligarh in Criminal Case No.4 of 1990 arising out of an application moved by the appellant, under Section-340(1) Cr.P.C. refusing to make a complaint under Sub- Section (1) and (2) of Section 340 Cr.P.C.
Vide report of the Chief Judicial Magistrate, Hamirpur dated 2.7.2018, it has been intimated that the sole appellant Rakesh Kumar had died on 20.11.2013.
In view of above, this appeal is liable to be dismissed as abated. The present appeal is, accordingly, dismissed.
