Court No. - 1
Case :- CRIMINAL MISC. WRIT PETITION No. - 24303 of 2018 Petitioner :- Rakesh Kumar Respondent :- State Of U.P. And 8 Others Counsel for Petitioner :- Vinay Kumar Upadhyay Counsel for Respondent :- G.A.
Hon'ble Ramesh Sinha,J. Hon'ble Dinesh Kumar Singh-I,J.
Heard Sri V.K. Upadhyay, learned counsel for the petitioner, Sri N.K. Verma, learned AGA for the State and perused the record.
This petition has been filed with the prayer to direct the respondent nos.2, 3 and 4 to arrest the respondent no.5 to 9 in case crime no.545 of 2018, u/s 147, 148, 149, 307, 504, 506, 427, 34 IPC, P.S. Jevar, district Gautam Budh Nagar.
Learned counsel for the petitioner submits that the petitioner is the injured of the case. The respondent no.5 has been released by the police on furnishing the personal bonds. The police has not arrested him and the release of respondent no.5 by the police by furnishing personal bond appears to be illegal, hence the petitioner has come up before this Court with the prayer to direct the respondent nos.2, 3 and 4 to arrest the respondent no.5 to 9.
After having considered the submissions advanced by learned counsel for the parties and from the perusal of the FIR, we do not find any good ground to interfere in the matter. The prayer to arrest the respondent nos.5 to 9 is refused.
The writ petition is, accordingly, dismissed.
