Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of S.T. No. 538 of 2015 (State Vs. Mukesh @ Billa others) arising out of Case Crime No. 0271 of 2015, under Sections- 147, 148, 149, 302 I.P.C., Police Station- Kotwali, District- Mathura, pending before the Additional Sessions Judge, Court No.3, Mathura.
Argument is that the charges have been framed in the year 2015. It has been submitted that witnesses of fact have been examined, only for one witness remains to be examined, but the accuseds are avoiding the conclusion of trial by changing their counsel, repeatedly.
Without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to proceed with the trial and conclude the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of six months from the date of production of a certified copy of this order, if there is no other legal impediment.
