Heard Sri Vinod Kr Pandey, learned counsel for the applicant and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing order 3.7.2017 passed in S.T. No.84 of 2014 arising out of Case Crime No.196 of 2014 under Sections 363, 366, 376 I.P.C. an POCSO Act, Police Station Sarnath, District Varanasi.
The prayer for quashing the proceedings as well as order impugned is refused.
However, it is provided that if the applicant files an application for recalling of the non-bailable-warrant issued against him within a period of three weeks from today, the said application shall be considered and disposed expeditiously in accordance with law. For a period of three weeks, no coercive action shall be taken against the applicant. However, in case, the applicant does not appear before the Court below within the aforesaid period, coercive action shall be taken against him.
With the aforesaid observations this application is finally disposed of.
