Heard learned counsel for the parties.
By the instant writ petition, petitioner seeks following relief:
i) issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to finalize the demarcation proceeding of Gata No. 1194 area 0.2390 hectare situated in village Bhoobra Mustahkam, District Rampur, and adjacent chak road which has been encroached by villagers and petitioner facing hardship on the spot."
Learned Standing Counsel submits that the third respondent, Sub Divisional Magistrate, Tehsil Swar, District Rampur, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the third respondent, Sub Divisional Magistrate, Tehsil Swar, District Rampur, to consider and decide the application of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
