The prayer in the present petition is to issue a direction to the Principal Judge, Family Court, Bijnor to decide the Matrimonial Petition No.523 of 2018 (Rajkumar Vs. Smt. Kajal) within stipulated period.
A perusal of the order sheet indicates that the respondent-wife has put in appearance in the aforesaid suit and has filed an application under Section 24 of the Hindu Marriage Act' 1955 which though has been dismissed for non prosecution vide order dated 21.12.2018 but on the same date, the respondent-wife has sought recall of the said order by moving an application Ka-16. It is admitted to the learned counsel for the petitioner that the wife is appearing in the matter and she has sought maintenance pendente lite so as to contest the divorce suit filed by her husband/petitioner and the petitioner is contesting the said proceeding.
In view of the said scenario, there is no justification to issue any direction in the present petition.
Dismissed as such.
