Rajeshbhai vs Yusuf

High Court Of Gujarat|08 January, 2012

JUDGMENT / ORDER

What is challenged in the present petition is the order passed by the Collector with respect to the mutation entry. It is not in dispute that against the order passed by the Collector, petitioner has a statutory alternative remedy available under the provisions of the Bombay Land Revenue Code and Rules by way of Revision Application before the Secretary (Appeals), Revenue Department, State of Gujarat. Hence, in view of the above, the present petition is not entertained and is accordingly dismissed. As and when the petitioner submits an appropriate application for getting back the certified copies of the order passed by the authorities below, so as to enable the petitioner to challenge the said order before the Secretary (Appeals), Revenue Department, State of Gujarat, Registry is directed to return the same to the petitioner at the earliest and within a period of two weeks on completing necessary procedure and formalities.
