Heard Mr.R.S. Sanjanwala, learned Senior Advocate with Mr.Dilip L. Kanojiya, learned advocate for the petitioners. It is submitted by him that the impugned notice under Section 76A of the Bombay Tenancy and Agricultural Lands Act, 1948 has been issued dehors the proviso that prescribes a limitation of one year for exercise of revisional powers. In support of the above submissions, reliance has been placed upon the judgment delivered by a Devision Bench of this Court in Thakorebhai Tribhovan Rao and others Vs. State of Gujarat and others reported in 1995 (1) GLH 758.
Issue Notice, returnable on 07.05.2012.
By way of ad-interim relief, it is directed that the proceedings in respect of the notice dated 21.09.2011 issued by respondent No.2, shall remain stayed till then.
In addition to the normal mode of service, Direct Service is also permitted.
