Heard learned counsel for the petitioner and learned counsel appearing for contesting respondents.
This petition impugns an order dismissing a statutory revision as being time barred.
The revision was preferred against an order dated 27 January 2001 cancelling Patta granted in favour of the petitioner under Section 198(4) of the U.P. Zamindari Abolition and Land Reforms Act, 1950.
From the record, it is evident that the petitioner was put to notice of proceedings by the Assistant Collector and she had also appeared and filed her objections. The order of 27 January 2001 was thereafter assailed by the petitioner by preferring a revision in 2004. The Court below has proceeded to dismiss the same holding it to be hopelessly time barred.
The Court notes that the respondents in their counter affidavit have set forth details of the land held by the petitioner in her own name as well as in the name of her husband. The assertion made is that the petitioner together with her husband hold 20 Bighas of land. In view thereof, the petitioner cannot be a landless labourer. In that view of the matter, the Court finds no ground to interfere with the order impugned.
The writ petition is dismissed.
