Heard learned counsel for the petitioner.
Grievance of the petitioner is that objection dated 17.08.2016 filed by the petitioner with respect to apportionment of the compensation with respondent no. 5 is pending till date and the respondents are proceeding to make payment of compensation to respondent no. 5 without adjudicating on the objection.
Shri Pranjal Mehrotra appearing for respondent no. 2 states that decision is to be taken by respondent no. 3, Competent Authority/Special Land Acquisition Officer, Azamgarh represented by learned Standing Counsel.
In such circumstances, we dispose of the writ petition by commanding the respondent no. 3 to take appropriate decision on the objection filed by the petitioner by means of a reasoned and speaking order in accordance with Section 3A (3) of the National Highways Act within a period of four weeks from the date of production of a certified copy of this order after notice and opportunity of hearing to all concerned.
Till decision on the objection, as directed aforesaid, payment of compensation shall not be made to either of the parties.
