Heard Shri Raj Karan Yadav, learned counsel for the petitioners and Rama Kant Dubey, learned Standing Counsel for the State respondents.
The petitioners are before this Court with request to issue direction to the respondent to correct the revenue record of old plot no.79, new no.40, situated in Village Tulapur, Tehsil Phoolpur, District Allahabad according to order/Parwana dated 07.04.1997 as well as 04.09.1997 issued by competent authority. Further prayer has been made to direct the respondent to correct the revenue record of plot no.79, new chak no.40, situated in village Tulapur, Tehsil Phoolpur, District Allahabad in the name of petitioners.
Learned Standing Counsel submits that the grievance of the petitioners is liable to be looked into and remedied by Sub Divisional Magistrate, Phoolpur, District Allahabad and in case any application is moved before the Authority concerned, the same would be considered by the petitioner at the earliest.
Considering the facts and circumstances of the case, this Court is of the considered opinion that in case any fresh application has been moved within two weeks from today, then the same would be considered and decided by the Sub Divisional Magistrate, Phoolpur, Allahabad expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him but certainly after according opportunity of hearing to all the stake holders in the matter.
With these observations, the Writ Petition is
disposed of.
